HOW DOES IT WORK?

1. What is the Titling arrangements?
Title to the land on which Waterdale Living Estate stands is freehold. You own your own home. The lot upon which your home is sited is leasehold. The lease is registered with the Land and Titles Office in your name. You pay a weekly General Service Fee.

2. Are Exit Fees payable at the time of the resale of the home?
Yes. The development of a Retirement Resort involves considerable capital expenditure on common facilities. The Exit Fee meets some of these costs without involving a drain on the weekly income of residents.

3. What type of contract do I enter into when I buy the home?
You enter into a construction contract for the home and before construction you sign a Lot Lease Agreement .

4. Am I liable for any additional charges?
You must pay your weekly General Service Fee, your own electricity, telephone, home insurance and for your clinical care.

5. Does the General Service Fee increase?
The fee is reviewed each year and takes into consideration any increases relate to the Consumer Price Index, Government rate increases and administrative costs.

6. Can I sell my home?
Yes, anytime.

7. Why should I consider a move to a Waterdale Living Estate?
There are a variety of personal and practical reasons why people will choose to retire to a Waterdale Living Estate.

  • The option to be free of the responsibilities of a larger home, with the freedom to travel knowing that all is cared for whilst you are away.
  • The companionship and friendship of the Estate lifestyle that allows you to pursue, at your own pace, a wide variety of activities.
  • The support of caring staff, and the new friendships that will evolve.
  • The security of additional care should it become necessary at some future time.
  • The knowledge, comfort and freedom to your family that you are part of a caring community, and they are no more than a phone call away.

However, it is finally you who should determine what the Waterdale Living Estate lifestyle has to offer you.

8. What age do I have to be?
Either yourself, your spouse or your partner must be a minimum of 55 years of age.

9. Who should I talk to, to assist with this decision?
Well, firstly, there is no substitute for family. Waterdale Living encourage the members of your family to be involved not only in the decision making process but also in the choice of Village lifestyles available to you. Feel free to talk to Waterdale Living residents, as they have made their own decision and are only too happy to assist new residents.

Waterdale Living staff are trained to assist, but finally it is you who should be clear and relaxed about the decision. If necessary we would encourage you to seek financial or legal advice about this decision.

10. What say do I have in Estate affairs?
A Management Advisory Committee will be established to advise the Waterdale Living Estate Management on matters concerning the resident's welfare etc.

11. What happens if the Estate is sold and there is a change of management that differs from the current style of management?
There can naturally be no guarantees that this situation would not occur. However, Anthony Cougle and the Waterdale Living team are actively engaged in the management of each Estate, and have in place training and succession plan to ensure the continuance of Waterdale Living philosophies. In any case, any new management would be bound to abide by the terms and conditions of any existing Lease Agreement.

12. What types of accommodation are available at the Waterdale Living Estates?
At Waterdale Living Estates we only have freestanding homes have a variety of home floor plans consisting of one, two or three bedrooms, or two bedrooms with study. All homes have either a garage, carport or car space. Buildings are totally flexible to meet your exact needs.

13. May I bring my pet?
We understand the strong attachment that many people have to their pets, and we will do everything we can to accommodate their needs. Small indoor pets are often not a problem but larger pets are most likely impractical. You most seek written approval from management for your particular pet. Once your pet passes away it is better that you don't purchase another..

14. What facilities and activities are available to me as a resident?
The Community Building consists of the general reception and management offices, as well as health professionals consulting rooms, billiard room, library and gym. Activities catered for include concerts, meetings, cards and a host of special functions.

The craft room allow residents to discover their artistic skills at pottery, china painting, art classes and a host of other craft pursuits. There is no charge for most of these activities as they are provided for through the General Service Fee.

“ The shed ” a facility for wood work and hobbyist is located near the “ Vegetable Garden ” .

There are residents' committees to promote all the Estates recreational activities including theatre excursions, trips and tours. Feel free to join us in whatever activities take your pleasure, or suggest additional activities or pursuits.

15. What form of contract do I sign?
A Lot Lease Agreement for the occupancy of your house lot.

16. How does the Lease Agreement for a home site operate if I wish to leave the Village?
As in all real estate, a Purchaser must be found who wished to buy your home. They must naturally comply with the conditions of the lease and be approved by management.

If you choose, you may employ a real estate agent to sell your home on your behalf and at your expense or the Waterdale Living team can sell if for you. No real estate board or advertising is permitted externally or within the Estate.

17. What charges do I face by living in the Estate?
The Resident is responsible for all their normal living expenses including telephone and electricity connection and running costs. Each resident is responsible for the internal redecorating and maintenance of their home. There is a Weekly General Service Fee charge, payable by all Residents.

18. What does the Weekly General Service Fee cover?
The Weekly General Service Fee is the proportion allocated to your lot of the total outgoings of the Estate and includes, but is not limited, to the following:
  • Rates and charges.
  • All fire insurance, public risk, workers‚ compensation etc. A contents and personal effects policy is not included on your behalf.
  • Public lighting, lawn mowing and gardening of the common areas.
  • General and long term maintenance of the present and future buildings, roads, courts etc., as well as the external maintenance.
  • Cost of providing or contributing to a bus service for the Estate Residents.
  • Cost of cleaning the common areas, e.g. corridors, lounges, building etc.
  • Costs of administration and management of the Estate.
  • Staff salaries, long service leave and superannuation entitlements.
  • Cost of providing and maintaining the emergency call and response system.
  • State or federal charges, taxes, etc.
  • A modest profit for the development and management company.

19. May I lodge a Caveat to protect my financial interest in the Estate?
Under the lease agreement a Resident is not permitted to lodge a Caveat.

20. Are there any housekeeping services?
Estate staff can arrange, at the Resident's expense, for private housekeeping assistance.

21. Is there staff available to assist with maintenance?
Maintenance external to your lot is paid for as part of the Weekly General Service Charge. However the Estate staff can arrange for any professional services you may require for internal maintenance or odd jobs, together with any assistance with your home garden. There is a charge for these services.

22. Is the dining room available for special functions?
With prior notice, arrangements can be made for those special functions, such as birthdays, anniversaries or family get-togethers. The cost of these functions is at the expense of the Resident.

23. What if I wish to temporarily leave the Estate, for example vacations or hospital?
You are naturally free to come and go as you please. All you need to do is notify Management that you will be away so we can look after your home. Your Weekly General Service Fee is payable whilst you are absent. During your absence we will attend to your lawn mowing and any external maintenance that may occur. You only have to ring us when you decide to come home and we will even open the windows to air your home or turn on your heating for you.

24. Is there an emergency call system, and who attends those calls?
The Estate has a 24 hour a day, all year, emergency call system.

25. What if I do not drive or decide to sell my car. Is there transport available?
The Waterdale Living community bus service runs Monday to Friday for access to the Shopping Centres and other places of interest.

26. May I rent or sub-let my home?
In order to maintain the amenity of the Estate renting or sub-letting is not allowed.

27. May I have a friend stay?
Your guests at the Estate, your children and grandchildren are welcome. You can feel free to entertain them in the Community Building or the gardens. In other words, your Waterdale Living Estate is your home. They must however be in your company if they are using any facility or engaging in any Estate activity. Your guests may stay, provided you are also in occupation, for up to four (4) weeks in any one year. Any extended stay is subject to obtaining the permission of Management.

28. Is there provision in the Lease Agreement for another party to own the Lease?
We have provision for an annexure to be added to the Lease Agreement to note any financial interests of another party. For example a Company could purchase your home on your behalf, or a family member could contribute towards part or all.

29. Can a family member or friend take up the Lease of my home lot in the event of my death?
The Lease is non-transferable.

30. Can a family member or friend move into the home permanently and not be noted on my Lease Agreement?
The Lease Agreement for your home lot has provision that in the event of a sole Resident requiring permanent assistance, then a carer, for whom Management has given written approval, may take up occupancy in the home to assist the Resident. When you leave the estate it is only natural that your carer must also leave.

There is also provision for a guest to stay for predetermined fixed periods which have been agreed to by Management.

31. What happens if I decide to marry or remarry after I have moved into the Estate?
Providing one member of that union is a minimum age of 55 years, the existing Lease Agreement allows for the spouse's name to be added to the Agreement.

32. What procedures are available if I am in dispute with Management?
The Management Advisory Committee is able to assist with any disputes. Also, the Lease Agreement provides for special dispute resolution process.

33. What are my responsibilities?

  • To pay the legal costs in respect of the Lease Agreement.
  • To use your home only as a dwelling.
  • To permit Management to inspect the condition of your lot grounds from time to time.
  • To be responsible for your guests whilst they are within the Estate.
  • To be responsible for the upkeep of your home and house lot and as such will pay their own personal costs for services such as the general service fee; care support fees, electricity, gas, water, phone, home and contents and public risk insurance
  • To abide by the Residents' Estate Rules, a copy of which is included in the Lease Agreement.

34. Who is the developer of the Estate?
Anthony Cougle is the Managing Director of the development company Waterdale Living Pty Limited. He is also Managing Director of the Management Company for each Estate. It is his vision to create extremely high quality, resort-style seniors living communities in the major provincial towns of NSW.

35. What if I have to sell my existing home before I can purchase my new home at the Estate?
A substantial number of future residents will need to sell their homes before they can move into a Waterdale Living Estate. Because we understand this, our contracts allow you three months to sell your home. This means you can choose your house lot and your house style and still have plenty of time to sell your existing home.

36. What type of financial outlay will be involved and what will my ongoing costs be?
The resident will pay a weekly General Service Fee, estimated to be $105 per week for the 2005/2006 year. The General Service Fee will be paid to Waterdale Living via direct debit from the Resident account. The Resident will not pay council rates or body corporate fees. There is an Exit Fee, but no stamp duty or legal fees payable.

37. Will I be entitled to any Federal Government rental assistance?
If you are already on or are eligible for a pension, you are entitled to Government Rental Assistance. The amount of rental assistance you are entitled to vary with each individual depending on the Asset Test and other conditions. Rental assistance can be quite substantial and is also indexed periodically to keep up with inflation. Please visit www.centrelink.gov.au
